Definitions
For the purposes of these Terms and Conditions, the following definitions shall apply:
- "Company" / "Medipedia" / "We" / "Us" refers to Medipedia Overseas Education Pvt. Ltd., a company duly incorporated under the Companies Act, 2013, and approved by the Government of Punjab.
- "Student" / "Parent" / "You" refers to the individual who has registered with the Company for admission counselling services, along with their parents or legal guardians.
- "Services" refers to all counselling, guidance, documentation, application, and support services offered by the Company for MBBS/MD/MS/BDS/BVSC/BAMS admissions in India and abroad.
- "University" / "Institution" refers to any medical college or university in India or abroad where admission is sought on behalf of the Student.
- "Service Fee" / "Consultancy Fee" refers to all fees paid by the Student/Guardian to the Company for availing the Services, including registration fees, processing fees, and service charges.
- "Agreement" refers to this Terms and Conditions document, together with the Registration Form and any Affidavit signed by the Student and their parents/guardians.

Acceptance of Terms
By registering with Medipedia Overseas Education Pvt. Ltd. and making any payment towards Services, the Student and their parents/guardians (collectively referred to as the "Parent") acknowledge that they have read, understood, and unconditionally agreed to be bound by these Terms and Conditions.
These terms constitute the entire agreement between the parties and supersede all prior understandings, representations, or agreements, whether written or oral.

Scope of Services
3.1 Services for MBBS/MD/MS/BDS/BVSC/BAMS in India
The Company shall provide the following services for medical admissions within India:
- State-wise Medical College Details: Seat Matrix, Establishment, Fees, Cut-Off, and Service Bond information.
- NEET Counselling: 24x7 alerts for NEET Counselling and Admission related dates and instructions via Telegram, WhatsApp, and Voice Call.
- NEET Score vs MBBS Budget: NEET score-based analysis for best-fit colleges within the Student's budget with the best education and clinical exposure.
- Personal Counsellor: A dedicated personal counsellor with a 3-level support system and direct discussion with Company Directors.
- Counselling (MCC & State): Complete assistance with Form Filling, Registration, Document Verification, Choice Filling, Seat Allotment, and College Reporting.
- Upgradation Support: Assistance for upgrading from Round 1 to Round 2 counselling.
- First to Last Round Support: Complete NEET Counselling support including Round 3 and Stray Vacancy Round updates.
- Govt. / Mgmt. / NRI Quota: Assistance for admissions to Government Colleges, Private Colleges, and Deemed Universities.
- Security Refund Formalities: Assistance in tracking counselling security deposits.
3.2 Services for MBBS/MD Abroad
For international medical admissions, the Company shall provide the following services:
- Country & University Selection: Based on Student profile and budget.
- Entrance Exam & Interview Support.
- Admission Letter & Invitation Letter Assistance.
- Document Apostille: MEA Apostille and translation of academic documents.
- Fast Visa Processing & Flight Booking Assistance.
- Airport Drop & Pre-Departure Briefing.
- Education Loan Assistance and bank loan documentation support.
- NOC from Government Agencies.
- Fitness, Health & HIV Certificate Arrangements.
- Police Clearance Certificate Assistance.
- Forex Exchange & Remittance Fee Assistance.
Post-Departure Services
- Immigration Clearance assistance upon arrival.
- Travel support from Airport to University.
- SIM Card allotment and Bank Account Opening support.
- Hostel allotment and accommodation booking assistance.
- University Registration and contract signing assistance.
- Student ID, Hostel Card, and International Student Card issuance support.
- Embassy Legislation assistance.
- Medical Insurance Assistance and VISA Renewal Assistance.
- NEXT / USMLE / PLAB Coaching support.
- 100% support during the entire course duration through licensing examinations and postgraduate admissions.
3.3 Exclusions
The following are expressly excluded from the scope of Services and are the sole responsibility of the Student/Guardian:
- Tuition Fees: Shall be transferred directly to the University's bank account by the Student or Parent.
- Hostel Fees: Shall be paid directly to the University upon arrival.
- Personal Living Expenses: Including meals, travel, clothing, and miscellaneous expenses.
- Counselling Registration Fees: Payable to Government portals (AIQ/State) and must be paid directly by the Student/Guardian.
- Hotel/Accommodation Bookings: For accompanying parents during travel.

Service Fees and Payment Terms
4.1 Service Fee Structure – MBBS/MD/BAMS/BDS in India
The following fees are applicable for admission services within India (exclusive of 18% GST):
Service Category Registration Fee (Non-Refundable) MBBS Above 250 Marks Rs. 1,50,000 MBBS Less than 250 Marks Rs. 2,00,000 MBBS – NRI Quota Rs. 3,00,000 BDS/BVSC/BAMS Rs. 50,000 - 1,00,000 MBBS Abroad Rs. 75,000 – 2,00,000 Note: AIQ/State/Deemed/NRI Quota counselling registration fees are to be paid directly by the candidate from their own bank account and are not included in the above.
4.2 Payment Terms
- All Service Fees are payable as per the discussed terms during admission.
- Fees are payable via bank transfer, demand draft, cheque, or credit card in favour of "Medipedia Overseas Education Pvt. Ltd." for respective Medipedia offices.
- All fees are exclusive of GST at 18%, which shall be payable additionally by the Parent.
- Post-dated cheques submitted by the Parent shall be deposited by the Company upon successful admission of the Student to a medical college. It is the sole responsibility of the Parent to ensure adequate funds are maintained in the relevant bank account on the cheque date.
- Payments once made shall be subject to the Refund Policy as outlined in Section 5 of this Agreement.

Refund Policy
IMPORTANT NOTICE: ALL SERVICE FEES PAID TO MEDIPEDIA OVERSEAS EDUCATION PVT. LTD. ARE STRICTLY NON-REFUNDABLE UNDER ANY CIRCUMSTANCES. BY MAKING PAYMENT, THE PARENT UNCONDITIONALLY ACCEPTS THIS POLICY.5.1 General Non-Refundability
All registration fees, service charges, processing fees, and any other amounts paid to the Company are non-refundable once paid, regardless of:
- The Student's change of mind, preference, or decision to withdraw from the admission process.
- The Student's failure to qualify NEET or any other entrance examination.
- Non-receipt of admission by the Student for any reason whatsoever.
- Changes in Government policy, National Medical Commission (NMC) guidelines, or University regulations.
- Any force majeure events including but not limited to natural disasters, pandemics, war, civil unrest, or government orders.
- Visa rejection or denial by any embassy or consulate.
- The Student's failure to fulfil eligibility criteria for any University or course.
- The Student's failure to appear for or pass a personal/Skype interview conducted by a University.
- Any student whatsoever if after payment of university fees, admission fees or any other fees, decides not to pursue MBBS. Fees paid to the University towards tuition fees, hostel fees, or any other university charges are not refundable under any circumstances, whether before or after travel to the University in India or abroad.
5.2 Adjustments (Not Refunds)
In the following circumstances, fees already paid may be adjusted (not refunded) towards alternative services:
- If a Student registered for MBBS Abroad subsequently opts for MBBS India through the Company, the fees paid may be adjusted towards the applicable India service charges.
- If a Student registered for MBBS India subsequently opts for MBBS Abroad through the Company, the fees paid may be adjusted towards the applicable abroad processing charges.
- If a Student registered before the NEET examination fails to qualify, the registration fee shall not be refunded. However, the Student may utilise the registration for the subsequent year's admissions with the registration fee waived.
5.3 Post-Dated Cheque Policy
- Post-dated cheques submitted as part of the service agreement shall be deposited upon successful admission of the Student to a medical college.
- Cheques will not be returned if the Parent changes their mind after the commencement of the NEET counselling process.
- In cases where the Student does not secure admission despite all efforts, post-dated cheques shall be returned upon completion of all applicable counselling rounds.
- The Parent is solely responsible for maintaining sufficient balance in their bank account on the cheque date. Any dishonoured cheque shall attract legal action as per applicable law.

Obligations and Responsibilities
6.1 Obligations of the Student/Guardian
- The Student/Guardian shall provide accurate, complete, and truthful information and documentation at all times.
- The Student/Guardian shall be responsible for maintaining the safety and integrity of all original documents including but not limited to Passport, Visa, Academic Marksheets, and Admission Letters.
- The Student/Guardian shall comply with all applicable laws, regulations, and University rules during the entire study period.
- The Student/Guardian shall be solely responsible for the Student's conduct, behaviour, and legal compliance during the entire study period Abroad/India.
- The Parent acknowledges and agrees that the parents/guardians shall bear all financial obligations of the Student during the study period, including tuition fees, hostel charges, meals, study materials, and all other miscellaneous expenses.
- The Parent shall be responsible for any variation in tuition fees or other university charges caused by inflation, currency fluctuation, or University policy changes.
- All expenses specified in foreign currencies (USD, EUR, or otherwise) shall be payable at the prevailing exchange rate on the date the expense is incurred.
- The parents of the applicant declare that they are fully aware of and well-versed with all rules, regulations, and guidelines issued by the NMC & VCI, including eligibility criteria, course duration, internship requirements, licensing examinations, and registration norms. They acknowledge that their ward is pursuing MBBS education abroad voluntarily and shall remain updated with future changes in NMC/VCI guidelines.
- The parents further acknowledge that the consultancy/company bears no responsibility or liability for any consequences arising from changes in, or non-compliance with, NMC & VCI guidelines.
- It is the sole responsibility of the student to secure digital and physical copies of all important documents including NEET Score Card, Passport, Class 10th & 12th Mark Sheets, University Admission Letter, and other academic or identification records.
- Parents acknowledge that the sole purpose of the student's visit to the country/university is education and they shall remain fully responsible for the student's conduct during the entire study period.
- In case of any court case arising during the study period, the parents shall be solely responsible for defending the case and not Medipedia Overseas Education Pvt. Ltd.
- Attendance, academic performance, examination results, disciplinary actions, suspension, termination, or expulsion from any college/university shall be the sole responsibility of the student and parents. Medipedia shall not be held liable in any manner whatsoever.

Limitation of Liability
To the fullest extent permitted by applicable law, the Company's liability is expressly limited as follows:
- The Company is an educational consultancy providing guidance services only and does not guarantee admission to any specific university, college, or course.
- The Company bears no responsibility or liability for decisions made by any University, Government authority, Embassy, Consulate, National Medical Commission (NMC), or Veterinary Council of India (VCI).
- The Company bears no liability for delays, rejections, or complications arising from visa processing, immigration procedures, or embassy/consulate decisions.
- The Company bears no responsibility for personal liability of the Student including medical, legal, health, or behavioural matters during the study period abroad.
- The Company bears no responsibility for changes in NMC Guidelines, VCI Guidelines, University regulations, or Government policies that may affect the Student's eligibility, course structure, or career prospects.
- The Company shall not be liable for any indirect, consequential, special, or punitive damages arising out of or in connection with the Services.
- Medipedia shall not be held liable or responsible for any security deposit with colleges or universities in India or abroad.
- If a student registered under the General Category later converts to NRI or any other category, Medipedia shall not be liable for earlier registrations submitted under the General Category.

Confidentiality and Data Protection
The Company shall maintain the confidentiality of all personal, academic, and financial information provided by the Parent. Such information shall be used solely for the purpose of providing the Services and shall not be disclosed to third parties except where required by law or with the Parent's prior written consent.
By registering, the Parent consents to the Company sharing necessary information with Universities, Embassies, Government authorities, and partner organisations solely for the purpose of facilitating the admission process.

Relationship of the Parties
The Company is an independent educational consultancy. Nothing in this Agreement shall be construed to create a partnership, joint venture, agency, employment, or fiduciary relationship between the Company and the Parent.
The Company acts only as a facilitator and does not hold any authority to bind any University, Government authority, or Embassy to any specific outcome on behalf of the Parent.

Governing Law and Dispute Resolution
- This Agreement shall be governed by and construed in accordance with the laws of India and jurisdiction applicable to Medipedia Head Office registered in Sangrur, Punjab.
- Any dispute, controversy, or claim arising out of or in connection with this Agreement shall first be attempted to be resolved amicably through mutual negotiation within 30 (thirty) days.
- If the dispute is not resolved amicably within 30 days, it shall be referred to arbitration under the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be Sangrur, Punjab, India.
- The courts at Sangrur, Punjab shall have exclusive jurisdiction over any legal proceedings arising from or in connection with this Agreement.

Amendments and Modifications
The Company reserves the right to amend, update, or modify these Terms and Conditions at any time. Any amendments shall be notified to the Parent through official communication channels. Continued use of the Services following notification of any amendment shall constitute acceptance of the revised Terms.

Severability
If any provision of this Agreement is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.

Entire Agreement
This Terms and Conditions document executed by the Student and their parents/guardians constitutes the entire agreement between the parties and supersedes all prior negotiations, representations, warranties, and understandings.

Declaration
I/We have read, understood, and agreed to the above Terms and Conditions, Refund Policy, and all associated provisions. I/We confirm that the information provided is accurate and complete to the best of my/our knowledge.
